How Do I Tackle Longer Mark Questions In The Exam?

Scenario question

Step 1: Identify the law being examined in the scenario - give the examiner your legal authority (source(s) of law), being as specific as possible. Explain briefly what the law is and use case law (aim for 5+)

Step 2: Start taking the scenario apart sentence by sentence. How does the law explained by you at the start of the answer work in this scenario? Always use phrases like "liability' it is possible that D can be found liable a court may decide that.....

Step 3: Consider any options as you complete Step 2 - is it possible that the court may take a different view/approach? Is the law clear? Does case law suggest that there are different routes the CPS/court could take when dealing with D?

Step 4: Make a clear, concise conclusion which explains your final decision re. liability and summarises how the law works for this scenario.

Evaluation question

Step 1: Identify the law being examined in the question - give the examiner your legal authority (source(s) of law), being as specific as possible. Explain briefly what the law is and use case law (aim for 5+)

Step 2: It is very important to take a few moments to plan out what you want to say in these questions as they are tough questions that ask you to bring your learning together from different areas of the course. Start taking the question apart sentence by sentence. What are the key issues being raised in the question? How does the question fit in with case law you have learnt? What are the key ideas/theories/criticisms? Where do these come from eg. lawyers, academics?

Step 3: Once you have planned out Step 2, start building your argument. These questions usually draw on areas of the Nature of Law (eg. fault) so ensure that you bring this knowledge in.

Step 4: Make a clear, concise conclusion which explains your final decision in relation to the question. This question asks for a flowing essay that comes to a well-considered conclusion so you MUST always have a solid conclusion if you are aiming for the highest Mark Bands.
