R v Gullefer (1987)
D jumped onto greyhound racing track in
order to have the race declared void and
enable him to reclaim his money.
Conviction for attempting to steal was
quashed because act was only ‘merely
preparatory’.Although he tried to interfere
with the race, he had several other acts to do
before the theft (i.e. getting his money back).
E.g. to go to one of the betting points and
asking for the money back .
