I drafted the submissions and did the research. The case involved a misrepresentation claim and three defective goods claims. We successfully overturned a costs decision by the High Court. Precast NZ Ltd v. Any Step Ltd High Court (21.06.17) Case involved: assignment, IP rights and exclusive licences (issues of jurisdiction and divisibility), knowledge, assisting contractual breach, res judicata, fiduciary duties, Companies Act. We acted for
Precast in an eight day trial and successfully upheld their exclusive licence. Settled via the arbitration clause in the licence agreement.
